‘It Is Now or Never’: Supreme Court Issues Pan-India Directions to Enforce Solid Waste Management Rules 2026

Flagging “uneven” compliance with Solid Waste Management (SWM) norms across the country, the Supreme Court of India has said the present generation cannot afford to wait for further legislative refinement while gaps in implementation persist.

Observing that the right to a clean and healthy environment is an “inseparable part” of the right to life under Article 21 of the Constitution, a bench of Justices Pankaj Mithal and S V N Bhatti issued a slew of pan-India directions to ensure effective enforcement of the Solid Waste Management Rules, 2026, which will come into force from April 1.

In its February 19 order, the bench noted that compliance with municipal solid waste (MSW) and SWM Rules remains inconsistent across India. “While mandated at source, segregation into wet, dry and hazardous streams is still not fully realised in many urban and rural areas,” the court said.

The bench pointed out that massive dumpsites continue to operate in several metropolitan areas, despite bio-remediation efforts under existing mandates. It warned that neglecting municipal solid waste would impact public health as much as the economy, especially as India positions itself as a global player in technology-driven growth.

“It is now or never. Expecting high results without fundamental spadework of source segregation and infrastructure would be unreasonable. Every stakeholder is duty-bound to ensure the realisation of a waste-free India,” the court observed.

The order came while hearing two appeals arising out of separate directions issued by the National Green Tribunal concerning environmental compliance by the Bhopal Municipal Corporation under the Solid Waste Management Rules, 2016.

Key Directions Issued

The court designated councillors, mayors, chairpersons, corporators and ward members as “lead facilitators” for source-segregation education, making it their statutory duty to ensure citizen enrolment in implementing the 2026 Rules within their respective wards.

District collectors have been empowered to conduct infrastructure audits of solid waste management systems and oversee waste handling by municipal corporations, municipalities and gram panchayats. They must communicate identified gaps and corrective measures to the chief secretary in a time-bound manner.

Local bodies have been directed to:

  • Establish and publicise a clear outer time-limit for achieving 100% compliance.
  • Email photographic evidence along with compliance reports to district collectors to verify on-ground progress.
  • Immediately inform all bulk-waste generators about the 2026 Rules and the apex court’s order, ensuring full statutory compliance by March 31.
  • Launch public-awareness campaigns to educate citizens on waste minimisation, home composting, proper wrapping of sanitary waste and mandatory segregation.

Pollution control boards have been instructed to identify and expedite infrastructure for four-stream segregation—wet, dry, sanitary and special care waste.

Enforcement and Penalties

The court made it clear that non-compliance will no longer be treated as a mere administrative lapse. It outlined a three-tier enforcement framework, beginning with immediate fines for initial violations by waste generators or local authorities.

Continued non-compliance may attract criminal prosecution under environmental laws, extending to individuals responsible for contributing to or abetting violations, including officials who fail in their oversight duties. The court also noted that deployment of mobile courts is under consideration to address real-time violations.

Awareness and Education Measures

To bridge awareness gaps, the court directed that summaries of the Solid Waste Management Rules, 2026—particularly provisions concerning households—be translated into local languages of respective states and Union Territories.

It also asked the Ministry of Environment, Forest and Climate Change to issue directions under Rule 33 to incorporate solid waste management practices into school curricula.

The bench clarified that these directions are part of preparatory measures ahead of the April 1, 2026 effective date. It further requested chief justices of high courts and chairpersons of tribunals to ensure compliance with the 2026 Rules by all courts and tribunals within their jurisdictions from that date.

Reiterating the State’s constitutional duty to safeguard the environment, the court underlined that ensuring a waste-free India requires coordinated action from governments, institutions and citizens alike.

Shantmanu Sworn in as Jammu and Kashmir State Election Commissioner, Pledges to Prioritize Pending Local Body Polls

 Former bureaucrat Shantmanu was on Saturday sworn in as the State Election Commissioner of Jammu and Kashmir for a five-year term, emphasizing the urgent need to conduct long-pending panchayat and urban local body elections in the Union Territory.

The oath of office was administered by Lieutenant Governor Manoj Sinha at a ceremony held at Lok Bhavan. The event was attended by Chief Minister Omar Abdullah, Deputy Chief Minister Surinder Choudhary, Speaker Abdul Rahim Rather, Chief Secretary Atal Dulloo, and Director General of Police Nalin Prabhat.

Speaking to the media, Shantmanu described taking over the responsibility as a matter of “great happiness and pride.” He highlighted the significance of local body elections, stating, “These elections are vital pillars of our democratic framework, particularly in strengthening decentralised governance and grassroots development. Since they have not been held for some time now, it becomes all the more important.”

Shantmanu also assured that he would work with full commitment to ensure the effective discharge of his duties.

The tenure of municipal councils in Jammu and Kashmir ended in October-November 2023, while panchayats and block development councils completed their five-year term on January 9, 2024. With district development councils’ tenure ending on February 24, there will soon be no elected local bodies functioning in the Union Territory.

Officials noted that delays in holding local elections were due to factors such as the delimitation exercise and reservation of wards for Other Backward Classes. Recently, Chief Minister Omar Abdullah had stressed that his government was making arrangements to hold the elections at the earliest, but the vacancy in the State Election Commissioner’s post had been a major hurdle.

Under the Jammu and Kashmir Panchayati Raj Act and relevant Municipal Acts, the State Election Commission has the authority to prepare electoral rolls and conduct local elections. On February 17, Lieutenant Governor Manoj Sinha appointed Shantmanu, a 1991-batch officer of the AGMUT cadre who recently retired as Additional Chief Secretary and Financial Commissioner in Jammu and Kashmir, as the new State Election Commissioner. He succeeds B R Sharma, whose tenure ended in April 2024.

Doda Police Foils Illegal Bovine Smuggling Attempt; Vehicle Seized, FIR Registered

Doda, 21 February 2026:

In a continued effort to curb illegal bovine smuggling and enforce the orders of District Magistrate Doda, Police Post Assar under the jurisdiction of Police Station Assar successfully intercepted a vehicle carrying bovine animals in a cruel and illegal manner during early morning patrolling.

At approximately 03:40 hours today, a patrolling party led by Incharge Patrolling HC Mohd. Maroof Ahmed intercepted a Tata Mobile vehicle bearing registration number JK06B-4351 at Trungal Assar, which was proceeding from Thana Pani towards Batote. Upon inspection, the vehicle was found loaded with five bovine animals being transported without food or water and in conditions amounting to utmost cruelty, in violation of the District Magistrate Doda’s standing notification and relevant legal provisions.

The driver of the vehicle fled from the spot under the cover of darkness, abandoning the vehicle and the animals. The vehicle along with the bovines has been seized.

In this connection, FIR No. 04/2026 has been registered at Police Station Assar under Section 223 of the Bharatiya Nyaya Sanhita (BNS) and Section 11 of the Prevention of Cruelty to Animals Act. Investigation has been entrusted to PSI Amit Singh (EXJ-196477). Efforts are underway to identify and apprehend the accused involved in the illegal smuggling network.

Sunil Sharma Slams J&K Government Over Outsourcing of 23,000 Jobs, Warns of Youth Backlash

 Leader of Opposition (LoP) Sunil Sharma on Saturday accused the Jammu and Kashmir government of “shattering the dreams of unemployed youth” in the Union Territory by outsourcing around 23,000 jobs instead of filling them through a transparent recruitment process.

Addressing reporters after a mega BJP joining event at Sher-i-Kashmir International Conference Centre (SKICC), Sharma urged the Omar Abdullah government to revoke the order, warning of the “wrath of the youth” if it was not rolled back.

“The Abdullah government has outsourced, sold around 23,000 jobs instead of conducting transparent recruitment. It has shattered the dreams of poor, unemployed youth. This is a huge betrayal with the youth of J&K,” he said.

Citing a written reply by the government in the assembly to MLA Handwara Sajad Lone, Sharma noted that 22,886 positions were outsourced in the past two years across the region.

Sharma also alleged that the Abdullah and Mufti families misled people about the BJP to keep them away from the party. “Now the youth and political activists are joining the BJP, which proves the party’s growing acceptance in Kashmir and exposes the Abdullah family,” he said.

He further claimed, “The Abdullah family has lied, betrayed Kashmir, and spilled blood. Today, when the people of Kashmir are questioning them, it is BJP’s biggest success.”

On PDP chief Mehbooba Mufti questioning the Indo-US trade deal, Sharma said she was targeting Delhi instead of holding the National Conference government accountable in the Union Territory. “When Mufti should have questioned the government here for the youth of J&K, she is questioning Delhi. The people had voted you to sit in opposition and hold the NC accountable,” he remarked.

Sharma accused the PDP of being “friends with the NC,” revealing a “dual character,” and asserted, “The people of Kashmir should trust the BJP, and we will take both these families to task.”

Amit Shah Claims Naxalism Will Be Eliminated by March 31; CRPF Day Parade Held in Northeast for the First Time

Guwahati, Assam — Union Home Minister Amit Shah on Saturday asserted that Naxalism would be completely eliminated from India by the government’s March 31, 2026 deadline. He made the announcement while addressing the 87th CRPF Day Parade, held in the Northeast for the first time.

Shah highlighted the CRPF’s role in bringing stone-pelting incidents in Jammu and Kashmir down to zero, controlling ethnic violence in Manipur, and breaking the back of Maoists in just three years. He also praised the 21-day Operation Black Forest in the Karreguta Hills on the Chhattisgarh–Telangana border in April–May 2025, during which 31 Naxals were killed. CRPF personnel operated in scorching heat of 46°C, enduring extreme physical hardship to dismantle Naxal strongholds.

The Home Minister reflected that 10–11 years ago, India had three major hotspots — terrorism in Jammu and Kashmir, Naxal-affected areas, and insurgency in the Northeast — which are now centers of peace and development. He credited CRPF personnel for their sacrifices, noting that 700 personnel were killed in the Northeast, 780 in Naxal areas, and 540 in Jammu and Kashmir.

Shah said the peace achieved in Jammu and Kashmir post the abrogation of Article 370 would not have been possible without CRPF’s efforts. On the occasion, 15 CRPF personnel were awarded Gallantry Medals, 6 were conferred the President’s Police Medal for Distinguished Service, and the best-performing battalions received trophies.

CRPF Director General G.P. Singh described Operation Black Forest as having “broken the back of Naxals” and reiterated that Naxalism would be eradicated by the government-set deadline.

The ceremonial parade at Sarusajai Stadium featured eight contingents from across India, including women personnel, the Rapid Action Force (RAF), CoBRA commandos, and units from various sectors. Demonstrations included a complex rifle drill by women personnel, a high-risk hostage-rescue simulation by commandos, and a jungle warfare exercise by CoBRA, representing anti-Naxal operations.

The CRPF was first raised in 1939 as the Crown Representative’s Police (CRP) under British rule. Post-independence, in 1949, it was renamed the Central Reserve Police Force (CRPF) by India’s first Home Minister, Sardar Vallabhbhai Patel.
