Supreme Court Upholds New JKCA Constitution, Clears Path for Elections

New Delhi, March 2025: In a landmark decision, the Supreme Court of India has upheld the new constitution of the Jammu and Kashmir Cricket Association (JKCA), which was drafted under the supervision of the Board of Control for Cricket in India (BCCI). This verdict paves the way for a structured and transparent election process within the JKCA.

The ruling follows the Jammu and Kashmir High Court’s March 2021 directive, which transferred JKCA’s management to the BCCI. The High Court had mandated that the association’s constitution be aligned with the Lodha Committee’s recommendations, as approved by the Supreme Court.

To implement these directives, the BCCI formed a Sub-Committee in June 2021, comprising Brigadier Anil Gupta, international cricketer Mithun Manhas, and senior advocate Sunil Sethi. The committee worked meticulously to draft a new constitution, focusing on enhancing transparency and accountability in JKCA’s governance.

Following extensive stakeholder consultations and rigorous legal scrutiny, the BCCI approved the revised constitution. However, its registration faced delays due to objections from certain affiliated clubs. In today’s ruling, the Supreme Court dismissed these objections, affirming that the BCCI-approved constitution would stand as final, thereby allowing the much-anticipated elections to proceed.

Representing the BCCI in the case, Solicitor General of India Tushar Mehta, alongside Advocate Achyut Dubey for JKCA, successfully defended the new constitution. Brigadier Anil Gupta and Mithun Manhas represented the Sub-Committee during the crucial court hearing.

“We worked diligently to honor the court’s mandate, ensuring transparency in administration and streamlining the selection process,” said Brigadier Anil Gupta. “The registration process was stalled, but with the Supreme Court’s intervention, the process will now move forward,” he added.

The Supreme Court’s ruling marks a turning point in JKCA’s administration, ushering in a new era of fair governance and structured cricketing reforms in Jammu and Kashmir.

Kolkata Knight Riders’ IPL Home Match Likely to be Rescheduled Due to Ram Navami

Kolkata: The Kolkata Knight Riders’ (KKR) much-anticipated home clash against Lucknow Super Giants (LSG) on April 6 at Eden Gardens is likely to be rescheduled, as city police have not granted security clearance due to Ram Navami celebrations.

BJP leader Suvendu Adhikari had earlier announced that over 20,000 processions would take place across West Bengal on Ram Navami, significantly increasing security requirements throughout the state.

Following two rounds of discussions with city police on Tuesday, Cricket Association of Bengal (CAB) president Snehasish Ganguly confirmed that authorities “have not given the go-ahead” for the match.

“They have categorically said they won’t be able to provide adequate security. If there’s no police protection, accommodating a 65,000-strong crowd becomes impossible,” Snehasish stated.

“We have informed the BCCI, and there is still time to take a final call. Even last year, a scheduled IPL match on Ram Navami had to be rescheduled,” he added.

The encounter between KKR and LSG, owned by RPSG Group chairman Sanjiv Goenka, was expected to draw a massive crowd, as both franchises enjoy strong local support.

Last season, a similar situation led to the rescheduling of KKR’s fixture against Rajasthan Royals due to security concerns on Ram Navami.

Meanwhile, the 2025 IPL season is set to commence at Eden Gardens on March 22, with defending champions KKR taking on Royal Challengers Bengaluru (RCB). The season opener will be preceded by a grand 35-minute opening ceremony, with ICC chairman Jay Shah and other dignitaries expected to attend.

“It’s a marquee match with full demand for tickets. Eden Gardens is set to host an opening ceremony after a long time,” Snehasish said, declining to reveal further details about the event.

As fans await an official announcement from the BCCI, KKR supporters will hope for a swift resolution to the scheduling issue to ensure a smooth start to their team’s campaign at home.

New and Emerging Disasters Must be Included in Management Plans, Says Parliamentary Panel

A parliamentary panel has recommended that the central government expand its disaster management plans to incorporate “new and emerging” disasters such as heatwaves. The Department-related Parliamentary Standing Committee on Home Affairs, in a report tabled in the Rajya Sabha last week, also advised establishing a system for the periodic review and updating of the official list of disasters.

Regular Updates Needed in Disaster Management
“The committee recommends that the ministry may include new and emerging disasters in its disaster management plans, such as those caused by heatwaves,” the report stated. It further suggested a formal mechanism for the periodic review and update of the Notified Disasters list to ensure its continued relevance. This, the committee said, should be done through consultations with experts, stakeholders, and affected communities.

The 31-member panel, chaired by BJP Rajya Sabha MP Radha Mohan Das Agrawal, stressed the need for long-term disaster preparedness, considering climate change and the increasing frequency of disasters. It also recommended greater investment in disaster-resistant infrastructure, including hospitals, schools, and transport systems, to minimize damage and facilitate faster recovery.

Heatwaves a Growing Concern
Amruta S Nair, Climate Campaigner at Greenpeace India, called the recommendation to include heatwaves in the notified disasters list “a welcome and long-overdue step.” She emphasized that prioritizing heatwaves in disaster management plans would improve prevention, mitigation, and recovery efforts.

However, Nair cautioned that to make this move effective, gaps in financial planning and execution must be addressed. She called for a dedicated “heat budget” for heat action plans, legally binding and time-bound goals for accountability, and a specialized body to oversee these efforts and ensure inter-departmental coordination.

Current List of Notified Disasters
At present, disasters eligible for National Disaster Response Fund (NDRF) and State Disaster Response Fund (SDRF) assistance include:

  • Floods
  • Tsunamis
  • Hailstorms
  • Landslides
  • Avalanches
  • Cloudbursts
  • Pest attacks
  • Frost and cold waves

State governments can use up to 10% of their annual SDRF allocation for immediate relief from disasters they consider significant, even if they are not in the centrally notified list. Several states have previously requested the Centre to include events such as lightning, river and coastal erosion, and public health emergencies like Japanese encephalitis, Nipah, and COVID-19 in the eligible list for SDRF and NDRF funding.

Government’s Stance on Heatwaves as Disasters
Union Earth Sciences Minister Jitendra Singh recently informed the Lok Sabha that the 15th Finance Commission had considered states’ requests to expand the list of notified disasters to include heatwaves but did not find sufficient merit in it.

Heatwaves Becoming Deadlier
Extreme heat and sunstroke have claimed 10,635 lives in India between 2013 and 2023, according to government data. Last year, India experienced its harshest summer in 14 years, recording 536 heatwave days as per the India Meteorological Department (IMD).

During one of the most prolonged and intense heatwaves, India recorded 41,789 suspected heat stroke cases and 143 heat-related deaths. The IMD has predicted above-normal maximum and minimum temperatures across most parts of the country this summer, raising concerns over further casualties and economic impacts.

With climate change intensifying extreme weather patterns, experts stress the urgency of expanding disaster management frameworks to protect vulnerable communities. Whether the Centre will act on the parliamentary panel’s recommendation remains to be seen.

Omar Abdullah Acknowledges Limited Asset Distribution to J&K, Advocates Mutual Resolution

Chief Minister Omar Abdullah today acknowledged that Jammu and Kashmir has received fewer assets in the apportionment process following its bifurcation but stated that the distribution was carried out as per the recommendations of an Advisory Committee constituted under the Jammu and Kashmir Reorganization Act, 2019.

Responding to a written question and subsequent supplementaries by National Conference MLA Tanvir Sadiq in the Legislative Assembly during Question Hour, Abdullah said that while Jammu and Kashmir received a smaller share of assets, the government intends to resolve the issue through mutual understanding rather than legal battles, citing the ongoing dispute between Andhra Pradesh and Telangana.

Accommodation and Infrastructure Plans

“To address accommodation requirements, the Government has acquired a 3,179.58-square-meter plot in Dwarka, Delhi, on a perpetual leasehold basis from the Delhi Development Authority (DDA) for constructing a J&K Bhavan complex. Additionally, we are exploring the possibility of creating additional accommodation on Prithviraj Road in Delhi,” Abdullah said.

When Sadiq suggested that Jammu and Kashmir Houses outside the Union Territory should reflect local culture and cuisine like those of Rajasthan and Himachal Pradesh, Abdullah assured that J&K’s buildings will showcase its cultural heritage. He further stated that employment opportunities at these establishments would be given to local residents and that traditional Kashmiri and Dogra cuisines would be prioritized.

Concerns Over Chandigarh Property Transfer

During the session, NC MLA Nazir Gurezi raised concerns about the allocation of J&K’s property in Chandigarh to Ladakh. “Where will the patients from Jammu and Kashmir visiting PGI Chandigarh for treatment go?” he questioned.

Abdullah responded by clarifying that J&K still retains structures in Sector 17, Chandigarh, and plans are underway to modify and expand them to cater to patients visiting the city for medical treatment.

Asset Apportionment and Encroachment Issues

Abdullah stated that the apportionment of assets from the erstwhile State of Jammu and Kashmir was executed based on the Advisory Committee’s recommendations and a separate government-formed committee.

He highlighted that a significant portion of the Guest House at Chanakyapuri, Delhi, has been allocated to Ladakh, limiting accommodation options at J&K House in the national capital.

Addressing concerns over encroachments, Abdullah revealed that a J&K government-owned property in Delhi, measuring one kanal and 11.2 marlas, had been illegally occupied. “Unauthorized individuals who were not duly sanctioned by the Estates Office or the Resident Commission had taken over the property. However, they have now been successfully evicted, and the Resident Commissioner has regained possession of the premises,” he informed the Assembly.

Financial Liabilities and Resolution Efforts

The Chief Minister further noted that financial liabilities amounting to Rs 2,504.46 crore are yet to be transferred to Ladakh. “The matter has been taken up with the Ministry of Home Affairs and the Ladakh administration,” he said.

On August 5, 2019, the Central Government had bifurcated the erstwhile State of Jammu and Kashmir into two Union Territories—J&K and Ladakh—while also abrogating its special status. Abdullah emphasized that despite limited asset allocation, the J&K Government remains committed to ensuring fair distribution through mutual consensus and dialogue rather than prolonged legal battles.

Inaugurating a two-day orientation programme for Delhi MLAs at the Vidhan Sabha, Birla highlighted the high expectations of the people from their legislators and the newly-formed government.

Birla described Delhi as a “Mini India,” representing the country’s diversity in languages, cultures, and religions. He stated that legislators bear the responsibility of addressing public concerns through infrastructure development and social welfare initiatives.
