New Delhi, Apr 4: The Unlawful Activities (Prevention) Tribunal, led by Delhi High Court Judge Justice Sachin Datta, has confirmed the banning order of the Jammu and Kashmir Democratic Freedom Party (JKDFP), associated with Shabir Shah, as an unlawful association.
The legal proceedings were conducted by Additional Solicitor General Aishwarya Bhati and Advocate Rajat Nair on behalf of the Ministry of Home Affairs. The confirmation order of the tribunal is expected to be officially notified by the Government in the coming days.
The Ministry of Home Affairs (MHA) recently established the Unlawful Activities (Prevention) Tribunal to determine whether there is sufficient cause for declaring the Jammu and Kashmir Democratic Freedom Party as an unlawful association.
In October 2023, the Government of India had declared the JKDFP as an ‘Unlawful Association’ under Section 3(1) of the Unlawful Activities (Prevention) Act (UAPA) 1967. A press statement issued at the time highlighted the organization’s involvement in anti-national activities since 1998 and its promotion of separatism and terrorist acts in India.
The members of the JKDFP have been accused of inciting separatist sentiments with the aim of establishing a separate Islamic state in Kashmir, posing a threat to the sovereignty, security, and integrity of India. Several criminal cases have been registered against the organization under various sections of the UAPA 1967, IPC 1860, The Arms Act 1959, and Ranbir Penal Code 1932.
