PSA on criminal who looted train passengers by spiking their tea

JAMMU: A criminal involved in looting train passengers by allegedly serving tea mixed with some sedative substances was detained on Thursday after being slapped with the Public Safety Act (PSA) here, officials said.

A dossier was prepared by the railway police in Jammu incorporating detailed summary of all the unlawful activities carried by the criminal, Angoor Choudhary. Subsequently, the district magistrate slapped PSA against Choudhary, they said.

Police detained him to prevent him from acting in any manner prejudicial to the maintenance of the public order, they said.

“His criminal record manifests that he is a substantial threat to railway passenger security. Since his criminal acts are very dangerous and detrimental to the lives of innocent railway passengers, it was found a fit case to be recommended for PSA”, a senior police officer said.

Choudhary was looting passengers by allegedly served tea mixed with some sedative substances and carrying out gruesome criminal activities within and outside the state, they said.

Several cases are registered against him.

Separatist Shabir Shah’s J&K House Attached In Terror Funding Case

NEW DELHI, Nov 4: The Enforcement Directorate on Friday said it has attached Jammu and Kashmir separatist leader Shabir Ahmad Shah’s Srinagar house as part of a money laundering probe linked to a case of fuelling terrorist activities in the union territory.
The house, worth Rs 21.80 lakh, is located in Botshah colony, Sanat Nagar, in Srinagar’s Barzulla police station area, officials said. The money laundering case against Shah stems from a FIR filed by the National Investigation Agency (NIA) in May 2017 against Lashkar-e-Taiba chief Hafiz Saeed and others under various sections of the Unlawful Activities Prevention Act (UAPA).
”Shabir Ahmad Shah was actively involved in the activities of fuelling unrest in Kashmir valley by way of stone pelting, processions, protests, bandhs, hartals and other subversive activities.
”He was involved in receiving funds from terrorist organisation Hizb-ul-Mujahideen (HM) and other terrorists outfits based in Pakistan as well as from the Pakistani establishment through hawala and various other means and channels and these funds were then being used for fuelling and supporting militant activities in the Kashmir valley,” the ED said in a statement. JAMMU, Nov 4: Weather was partly cloudy in J&K as the Meteorological (MeT) office said on Friday that partly cloudy sky with possibility of light rain is expected during the next 24 hours.
“Partly cloudy sky with possibility of light rain is expected in J&K during the next 24 hours”, an official of the MeT department said.
Jammu had 15.8, Katra 14.8, Batote 9.7, Banihal 6.6 and Bhaderwah 6.2 as the minimum temperature.
Srinagar had 5, Pahalgam 1.3 and Gulmarg 0.5 degrees Celsius as the minimum temperature.
In Ladakh region, Drass town had minus 2.3, Kargil minus 3 and Leh also minus 3 as the minimum temperature. (Agencies)

Neither BCCI nor team is likely to respond to Kohli “fake throw” controversy

It has been learnt that neither the Indian team management nor the Board of Control for Cricket in India is going to respond to the alleged “fake throw’ incident involving Virat Kohli against Bangladesh on November 2 at the Adelaide Oval in the ICC Men’s T20 World Cup.

The reason is that the two on-field umpires Marais Erasmus and Chris Brown have had no issues about the incident, it is understood.

The on-field happening became the talking point when Bangladesh wicket-keeper Nurul Hassan told the media in the mixed zone in Bengali after the match that Bangladesh deserved to get five penalty runs as Kohli play-acted as if he was relaying the ball thrown by Arshdeep Singh from the deep to wicket keeper Dinesh Karthik even as the ball went past the area where he was stationed on the field and he didn’t collect it.

“The wet outfield did have an impact when we restarted the game (after a 45-minute rain interruption). But there was also a fake throw which could have got us five runs but we didn’t get even that,” Hassan told media persons in the mixed zone after the game which his team lost by five runs under the Duckworth Lewis Stern method for rain-interrupted matches.

As per the Laws of Cricket, 2019 Code, Law 45 dealing with “Deliberate distraction, deception or obstruction of batter”, says, “In addition to Law 41.4 (Deliberate attempt to distract the striker) it is unfair for any fielder wilfully to attempt, by word or action, to distract, deceive or obstruct either batter after the striker has received the ball. (Law 41.5.1)

“It is for either one of the umpires to decide whether any distraction, deception or obstruction is wilful or not.” (Law 41.5.2).

“If either umpire considers that a fielder has caused or attempted to cause such a distraction, deception or obstruction, he/she shall immediately call and signal Dead ball and inform the other umpire of the reason for the call.” (Law 41.5.3).

“Neither batter shall be dismissed from that delivery.” (Law 41.5.4)

“If an obstruction involves physical contact, the umpires together shall decide whether or not an offence under Law 42 (Players’ conduct) has been committed.” (Law 41.5.5)

“If an offence under Law 42 (Players’ conduct) has been committed, they shall apply the relevant procedures in Law 42 and shall also apply each of 41.5.7 to 41.5.9.” (Law 41.5.5.1).

“If they consider that there has been no offence under Law 42 (Players’ conduct), they shall apply each of 41.5.6 to 41.5.10 (Law 41.5.5.2).

The relevant Laws 41.5.6 to 9 say: The bowler’s end umpire shall Signal No ball or Wide to the scorers, if applicable, award 5 Penalty runs to the batting side, inform the captain of the fielding side of the reason for this action and as soon as practicable inform the captain of the batting side. The ball shall not count as one of the over. Any runs completed by the batters before the offence shall be scored, together with any runs for penalties awarded to either side.

Additionally, the run in progress shall be scored whether or not the batters had already crossed at the instant of the offence. The batters at the wicket shall decide which of them is to face the next delivery.

Law 41.5.10 says:The umpires together shall report the occurrence as soon as possible after the match to the Executive of the offending side and to any Governing Body responsible for the match, who shall take such action as is considered appropriate against the captain, any other individuals concerned and, if appropriate, the team.

Thus far the International Cricket Council has not come out with a statement about the controversy.

Omar will not contest Assembly polls till J&K statehood is restored: Farooq Abdullah

Omar Abdullah, former CM of J&K, will not contest the upcoming Assembly elections until J&K remains a Union Territory, National Conference president Farooq Abdullah has said. At the same time, the party has appointed heads of the 46 Assembly constituencies of Kashmir, seen as a step towards poll preparation.

In 2014, Omar won his last Assembly election from Beerwah constituency which will be headed by Muhmmad Shafi now. “Omar has made it clear that he will not contest the elections as long as Jammu and Kashmir’s statehood is not restored,” Farooq said in Budgam district.

A leader said the list of constituency heads had been issued to fill the gaps arisen by the Delimitation Commission’s fixing of new geographical boundaries for the Assembly segments.

However, the list of constituency heads is an indication that the NC may not have a pre-poll alliance with other constituents of the People’s Alliance for Gupkar Declaration and may go solo in the Assembly elections.

In August, the NC passed a resolution that it will contest all the 90 seats on its own but Farooq Abdullah later said that a decision on elections would be taken only when the Election Commission of India decides the dates.

L-G Mathur inaugurates 300-bed hospital in Kargil

Kargil/Jammu, Nov: Ladakh Lieutenant Governor R K Mathur on Thursday inaugurated a 300-bed district hospital in Kargil district and stressed the need for providing the best possible health facilities to the people of the Union Territory.

Constructed at a cost of Rs 40.37 crore, the hospital complex has come up at Lower Kurbathang in Kargil, officials said.

The LG congratulated the people for one of its kind state-of-the-art district hospital in Kargil.

He appreciated the efforts of the Kargil hill council along with the officials of the administration for making the construction of the district hospital with all facilities possible in a short time.

Mathur stated that the MRI machine would be sanctioned for the New district hospital in Kargil and further infrastructure expansion works would be made in the future so that the public could avail their benefits.

Chairman, LAHDC (Ladakh Autonomous Hill Development Council) Kargil, Feroz Ahmed Khan, thanked the administration for setting up the New district hospital in Kargil on behalf of the people.

He informed that the hospital was constructed in a short span of time despite the COVID-19 pandemic. PTI

PM declares war on corruption

Calling for an administrative ecosystem that has zero tolerance for corruption, Prime Minister Narendra Modi today said institutions acting against the menace need not be defensive and must ensure that no corrupt person, howsoever powerful he might be, was allowed to go scot-free.

”No corrupt person should get political-social support, every corrupt person should be put in the dock by society. It is necessary to create such an environment,” he said addressing a programme marking Vigilance Awareness Week of the Central Vigilance Commission (CVC).

The PM emphasised that there was no requirement for institutions acting against the corrupt and corruption like the CVC to work on any political agenda but to work towards making the lives of ordinary citizens simpler.

Touching upon what he called a worrying trend, Modi said; “We have seen that many times the corrupt people are glorified in spite of being jailed even after being proven to be corrupt. This situation is not good for Indian society. Even today, some people give arguments in favour of the corrupt who have been found guilty.”

The PM declared that for a developed India, trust and credibility were critical and claimed that previous governments not only lost people’s confidence but also failed to trust people. The legacy from the long period of slavery of corruption, exploitation, and control over resources, unfortunately, received more strength after the independence. This severely harmed at least four generations of this country, he said. “We have to change this decades-long way fully in the Azadi ka Amrit Kaal,” the PM added.

Recalling his clarion call from the ramparts of Red Fort for a decisive battle against corruption, Modi pointed out two key reasons for corruption that hindered people’s progress i.e. lack of amenities and unnecessary pressure from the government.

For a very long time, this absence of amenities and opportunity was deliberately kept alive and a gap was allowed to widen leading to an unhealthy competition of a zero-sum race. This race fed the ecosystem of corruption. ”

Corruption created by this scarcity affects the poor and middle classes the most. If the poor and middle class spend their energy arranging for the basic amenities, how will the country progress?” he wondered.

He said his government was trying to change this system of scarcity and pressure for the last eight years. It was trying to fill the gap between supply and demand. The three ways adopted to achieve this was advancement in technology, taking basic services to the saturation level, and heading towards ”Atmanirbharta”.

With regard to the use of technology, the PM mentioned linking PDS to technology and removing crores of fake beneficiaries, and saving more than Rs two lakh crores from going into the wrong hands by adopting Direct Benefit Transfer (DBT). Similarly, the adoption of transparent digital transactions and transparent government procurement through GeM was making a huge difference.

Speaking on taking the basic facilities to the saturation level, he pointed out that reaching every eligible beneficiary of any government scheme and achieving the goals of saturation would put an end to discrimination in society while eliminating the scope of corruption. Highlighting the principle of saturation that was adopted by the government for the delivery of every scheme, he gave examples of water connections, pucca houses, electricity connections, and gas connections.

The PM was of the view that too much dependence on foreign goods has been a big cause of corruption. He highlighted the government’s push towards ”aatmanirbharta” in defence and underlined that the possibility of scams was ending as India would be manufacturing its own defence equipment, from rifles to fighter jets to transport aircraft.

He also asked the vigilance community to think about modernising their audits and inspections. “The will which the government is showing against corruption, the same will is necessary to be seen in all the departments as well. For a developed India, we have to develop such an administrative ecosystem, which has zero tolerance on corruption”, he said.

The Prime Minister asked for a system where corruption-related disciplinary proceedings were completed in time-bound mission mode.

He also suggested continuous monitoring of criminal cases and asked to devise a way of ranking departments on the basis of pending corruption cases and publishing the related reports on a monthly or quarterly basis. He also called for streamlining of the vigilance clearance process with the help of technology.

Mother-daughter duo dead, man injured as house collapses due to landslide in Surankote

POONCH, Nov 4: A Mother-daughter dup died while a man was injured after a house collapsed due to a landslide in Bufliyaz village of Surankote area in Poonch district on Friday.
An official told that the incident took place near the site of a project for upgradation of road from Rajouri to Surankote.
He said that a landslide came crushing down on a residential house, burying three family members, following which a rescue operation was launched.
“After hectic efforts all three were rescued and were taken to SDH Surankote, where mother-daughter duo was declared dead on arrival. The male member of the family was referred to GMC Associated Hospital Rajouri,” he said.
Deceased have been identified as Naseem Akhter (34) wife of Mohammad Latief and her daughter Rubina Akhter (09) and the injured has been identified as Mohammad Latief son of Mohd Hussain.
Deputy SP Surankote said that a rescue operation is still going on at the site of the incident as some livestock are buried under the debris.

Active Covid cases in country dip to 15,705

New Delhi, Nov 4: With 1,216 people testing positive for coronavirus infection in a day, India’s tally of COVID-19 cases rose to 4,46,58,365, while the active cases declined to 15,705, according to the Union Health Ministry data updated on Friday.
The death toll climbed to 5,30,479 with 18 fatalities which includes 15 deaths reconciled by Kerala, the data updated at 8 am stated.
The active cases comprise 0.04 per cent of the total infections, while the national COVID-19 recovery rate increased to 98.78 per cent, according to the health ministry website.
A decrease of 393 cases has been recorded in the active COVID-19 caseload in a span of 24 hours.
The number of people who have recuperated from the disease surged to 4,41,12,181, while the case fatality rate was recorded at 1.19 per cent.
According to the ministry’s website219.69 crore doses of Covid vaccine have been administered in the country so far under the nationwide vaccination drive.
India’s COVID-19 tally had crossed the 20-lakh mark on August 7, 2020, 30 lakh on August 23, 40 lakh on September 5 and 50 lakh on September 16. It went past 60 lakh on September 28, 70 lakh on October 11, crossed 80 lakh on October 29, 90 lakh on November 20 and surpassed the one-crore mark on December 19.
The country crossed the grim milestone of two crore on May 4 and three crore on June 23 last year. It crossed the four-crore mark on January 25 this year.
Three deaths were reported in a span of 24 hours with one each in Maharashtra, Uttar Pradesh and West Bengal. (Agencies)

In a statement here today,DevrajThakur, President All Jammu Kashmir and Ladakh Teachers Federation aft. Akhil Bhartyia Rashtriya Shakshik Mahasangh said that thousands of teachers, and other staff members have been this way deprived of promotion chances.
Thakur revealed that teachers’ timely promotion in general has a great impact in the pupils’ learning progress and outcomes. As motivation increases through improved working environment and timely paying teachers’ claims, the level of performance also increases.This is because of the discriminative approaches of the School Education Department who were at helm of affairs in the department over the years.
In examining the role of timely promotion, Thakur reveals that teachers’ timely promotion have the great role in increasing the teachers work morale. Thakur further added that promotion opportunities build willingness in employees to work, hence stability in works and it’s recognition is one of the most significant motivating factor among the industrial workers which enables them to achieve high productivity.
He further added that establishment of incentive schemes and wages work as a means of stimulating workers to work hard to be committed and eventually to be satisfied with the motivation they get, and suggested that, when teachers are timely promoted/motivated they will love their teaching profession; they will teach effectively that may
help the pupils to increase their academic performance.

 He said that another grave problem in the Department is failure of the Department to adopt a concrete policy for rejuvenation of this important department and framing of a proper transfer policy for the members of teaching community. While some teachers posted in far off places for several years crave for their transfer to their home districts those who are favouritism manage their postings in capital cities or near their vicinity.

   Thakur said that the department having no definite policy with regard to the transfer of teachers was leading to unnecessary confusion every year. Teachers form the largest group among the government employees. However, the department have failed to implement a definite transfer policy in Jammu Kashmir. The teachers have been demanding transfers to ensure better quality of education.

However, the government is yet to consider seriously the need for having a transfer policy for school teachers and implementation of ATD-2022 in favor of teaching community. Regarding the transfer the government should make some forward move in consultation with teachers, officials and experts, he said.
“The teachers in J&K UT are agitating for non seriousness of the department to transfer them in times in suitable places and the grave concern among the teachers however is failure of Government to conduct the DPC yearly.

     "AJKLTF appeal to the higher authority to take the appropriate actions and instructions for the Education department to fulfill the long pending demands of teaching community.The teachers are the worst suffered due to not transparent transfer Policy in J&K UT and lack of staff in schools especially in far-flung areas has been another cause of concern for teaching community as well as students, he added.

   "This is affecting the education to a great extent. The issue has been taken up before government many times but to no avail.This negative policy of Government has also been a cause that teachers have been deprived of their genuine rights and failure of Education system in J&K," he added.

“The growing discrimination towards the teaching community members of Jammu Kashmir has led to lot of resentment among them and in case the same was not done away with immediately the teachers community will be forced to come to streets to register it’s protest against the Government,” Thakur added.
