Omar Abdullah Pays Homage to National Conference Founder Sheikh Mohammed Abdullah

Srinagar, Oct 16: Omar Abdullah, the Chief Minister-designate of Jammu and Kashmir, paid tribute to his grandfather and National Conference founder, Sheikh Muhammad Abdullah, on Wednesday ahead of his swearing-in ceremony.

Dressed in a traditional Pathani suit and coat, the 54-year-old Abdullah offered floral tributes at Sheikh Abdullah’s mausoleum in Hazratbal.

A National Conference spokesperson stated, “Omar Abdullah paid respects at his grandfather’s grave ahead of taking oath as the first Chief Minister of Jammu and Kashmir Union Territory.”

The swearing-in ceremony, where Abdullah and his ministers will take the oath of office and secrecy, is scheduled for 11:30 am and will be administered by J-K Lieutenant Governor Manoj Sinha.

Official sources stated that Ottawa’s claim of having shared evidence with New Delhi regarding the Nijjar case was unfounded.

The diplomatic rift between India and Canada escalated on Monday when India expelled six Canadian diplomats and announced the withdrawal of its High Commissioner from Canada, dismissing Trudeau’s assertions that linked the Indian envoy to an investigation into the killing of Sikh extremist Hardeep Singh Nijjar.

A source commented on Trudeau’s recent press conference, stating, “It was the same old Trudeau saying the same old things for the same old reasons.” The sources categorically denied the Canadian officials’ claims that credible evidence had been presented to India in the Nijjar case. They emphasized, “This was also repeated by their Charge d’Affaires Stewart Wheelers to the press. This is simply not true.”

The Indian sources criticized Canada’s approach, describing it as vague accusations that place the burden of denial on India. India Slams Pakistan’s “Baseless Claims” on Jammu-Kashmir at UN, Calls for End to Human Rights Violations

New York [US], Oct 15: During the Joint General Debate on decolonization at the United Nations on Monday, Indian Counsellor Eldos Mathew Punnoose exercised India’s right to reply against Pakistan, condemning its “unsubstantiated allegations” regarding the Union Territories of Jammu and Kashmir and Ladakh. He urged Pakistan to cease its ongoing human rights violations in the regions it occupies.

Punnoose asserted, “Unsubstantiated allegations by Pakistan largely pertain to the Union Territories of Jammu and Kashmir and Ladakh. India reiterates that Jammu and Kashmir and Ladakh are, were, and will always be an integral and inalienable part of India. Clearly, Pakistan does not merit a response on the internal affairs of India.”

He further advised Pakistan to halt its “grave and ongoing human rights violations” in Pakistan-occupied Jammu, Kashmir, and Ladakh (PoJKL), highlighting the global awareness of Pakistan’s divisive activities. “India is built on the enduring pillar of democratic values, unlike Pakistan,” he emphasized.

Criticizing Pakistan, Punnoose noted its history of sham elections, political repression, and suppression of dissenting voices. “Pakistan is familiar with sham elections, incarceration of opposition leaders, and suppression of political voices,” he said, underscoring India’s recent election results in Jammu and Kashmir, where millions exercised their right to vote under a constitutional framework.

He pointed out the irony of Pakistan, a nation known for state-sponsored terrorism and transnational crimes, criticizing the world’s largest democracy. “Pakistan’s consistent state policy has been to employ cross-border terrorism as a weapon against its neighbors,” he stated, citing numerous attacks, including one on the Indian Parliament.

Punnoose contrasted India’s values of pluralism, diversity, and democracy with Pakistan’s reputation for terrorism and persecution. “India symbolizes pluralism and democracy, while Pakistan is synonymous with terrorism and persecution. Minorities and their places of worship are routinely targeted in Pakistan,” he remarked.

He added, “Pakistan’s obsession with India is evident as they continue to use this platform to spread malicious propaganda. They may exercise their right of reply, but I will refrain from responding. Facts speak for themselves. Lies remain lies, even when repeated by Pakistan.”

In his address, Punnoose also highlighted India’s commitment to the global struggle against colonialism, noting its historical role in promoting decolonization. “India has been a champion against colonialism, actively contributing to the decolonization agenda,” he said.

Pakistan frequently raises the Jammu and Kashmir issue at UN platforms and other international forums, despite India’s firm rejection of such attempts, asserting that Jammu and Kashmir, along with Ladakh, are integral parts of India, and Pakistan has no standing to comment on India’s domestic matters.

EC Set to Announce Poll Schedule for Maharashtra and Jharkhand Today

NEW DELHI, Oct 15: The Election Commission is set to announce the schedule for the Maharashtra and Jharkhand Assembly elections on Tuesday, October 15, 2024. A press conference has been scheduled at 3:30 pm in New Delhi, where the EC will reveal the poll dates and related details.

The current term of the Maharashtra Assembly ends on November 26, 2024, while the Jharkhand Assembly’s tenure concludes on January 5, 2025. In addition to the general elections for these assemblies, the Election Commission may also announce bypolls for three vacant Lok Sabha seats and at least 47 vacant Assembly constituencies across various states.

The vacant Lok Sabha seats include Wayanad in Kerala, Nanded in Maharashtra, and Basirhat in West Bengal. The Wayanad seat was vacated by Congress leader Rahul Gandhi, who opted to retain his Rae Bareli seat after winning both. The Nanded seat became vacant after the passing of Congress MP Vasant Chavan, and Basirhat is without representation following the death of TMC MP Haji Sheikh Nurul Islam.

Imran Khan’s Party Cancels Protest in Pakistan Ahead of SCO Summit

ISLAMABAD, Oct 15: Pakistan’s main opposition party, Pakistan Tehreek-e-Insaf (PTI), called off its planned protest on Tuesday as the 23rd meeting of the Shanghai Cooperation Organisation’s (SCO) Council of Heads of Government (CHG) commenced under tight security in Islamabad.

The two-day summit will focus on strengthening cooperation in areas such as the economy, trade, environment, and socio-cultural relations, while also reviewing the Organisation’s progress. Pakistan, which assumed the rotating chair of the SCO CHG for 2023-24 during the last meeting in Bishkek, is hosting the event, with Prime Minister Shehbaz Sharif presiding.

Key attendees include Chinese Premier Li Qiang, Russian Prime Minister Mikhail Mishustin, Indian External Affairs Minister S Jaishankar, and other high-ranking leaders from SCO member states.

PTI had planned to protest in the capital to demand a meeting with their jailed leader, Imran Khan, after authorities imposed restrictions on visits to inmates at Adiala Jail, Rawalpindi, in light of the summit. However, the protest was called off late Monday after the government assured that a medical team would be allowed to meet the 72-year-old former prime minister.

“After extensive negotiations, we decided to cancel the protest,” PTI spokesperson Zulfiqar Bukhari said, adding that political allies and foreign embassies also urged the party to reconsider.

The government had earlier warned of strict action against any demonstrations. To ensure security during the summit, around 10,000 police personnel, backed by paramilitary forces and the regular army, were deployed. Additionally, Section 144 was imposed in Islamabad and Rawalpindi, banning all public gatherings. The authorities also declared three days of public holidays to minimize disruptions during the conference.

Consensual Adulterous Relationship Cannot Be Classified as Rape: High Court Ruling

Prayagraj, Oct 15 : The Allahabad High Court has ruled that a consensual, long-term adulterous relationship, without any element of deception from its inception, does not constitute rape under Section 375 of the Indian Penal Code (IPC). Section 375 defines rape as sexual intercourse with a woman against her consent.

The court quashed the criminal proceedings against a man from Moradabad, Shrey Gupta, who was accused of raping a woman under the pretext of marriage. In its ruling, the court emphasized that a mere promise of marriage does not automatically convert consensual sexual intercourse into rape unless it can be demonstrated that the promise was deceitful from the start.

“Not every promise of marriage amounts to a misconception of fact for the purposes of consensual intercourse unless it is proven that the promise was false from the very beginning,” the court observed. It noted that unless allegations of cheating from the start of the relationship are made, a false promise of marriage cannot be presumed.

The court was hearing a petition filed by Shrey Gupta, who sought to quash the criminal proceedings against him under Section 482 of the Code of Criminal Procedure (CrPC). Gupta had been charged with rape (Section 376 IPC) and extortion (Section 386 IPC) based on a complaint filed by a woman.

According to the woman’s FIR, filed at Mahila Thana in Moradabad, Gupta had established a physical relationship with her after the death of her husband, promising to marry her. She later claimed that Gupta broke his promise and got engaged to another woman. The complainant also alleged that Gupta demanded ₹50 lakh to prevent the release of intimate videos.

However, the court, after reviewing the case, observed that the complainant, a widow, had been in a consensual relationship with Gupta for over 12 years, even while her husband was still alive. It further noted that the woman, who was much older than the accused, had exerted undue influence over him, as he was employed in her late husband’s business.

Citing the Supreme Court’s judgment in Naim Ahamed vs. State of Haryana, the court reiterated that not every breach of a marriage promise can be treated as a false promise, nor does it necessarily lead to rape charges under Section 376 IPC.

On October 1, the court quashed the criminal proceedings against Gupta, ruling that the allegations lacked the necessary legal grounds for charges of rape or extortion.
