Delhi, April 16: Rudra Buildwell Project Pvt. Ltd., a major construction company in India with a net worth of INR 2200 crores, is facing financial ruin due to its failure to pay a debt of INR 8.5 crores owed to Synergy Ventures. This debt has become a bone of contention between the two companies, and the matter is currently being heard by the National Company Law Tribunal (NCLT) in Delhi.
The NCLT was established in 2016 by the Modi government under the Companies Act of 2013. Its primary aim is to prevent economic offenses and safeguard the interests of banks, investors, and employees. The tribunal deals with a range of issues related to companies, including compromises, arrangements, restructuring, liquidation, and winding up.
Synergy Ventures filed two petitions, IB-76/PIB/2022 and IB-77/PIB/2022, with the NCLT on February 3, 2022, seeking redressal for the debt owed to them by Rudra Buildwell Project Pvt. Ltd. The case has been ongoing for some time, with advocates Shivam Kumar, Saurabh Pandey, and Uday Chandani representing Synergy Ventures, while Rudra Buildwell Project Pvt. Ltd. has repeatedly failed to present its case. Advocate Ravindra Singh has been representing the company in the proceedings.
In a recent development in the ongoing case between Rudra Buildwell Project Pvt. Ltd. and Synergy Ventures, the National Company Law Tribunal (NCLT) in Delhi has issued an order in response to an application filed by the Corporate Debtor, seeking the recall of an earlier order passed by the Tribunal on 3rd February 2023, which closed the right to file a reply by the Corporate Debtor. The NCLT heard submissions from the Ld. Counsel for the Corporate Debtor, Mr. Akshat Gupta, and the Ld. Counsel for the Petitioner, who vehemently opposed the prayers made by the Corporate Debtor. After considering the submissions, the NCLT decided that the Corporate Debtor should be given an opportunity to file its reply affidavit in the interest of justice, and therefore, recalled the order dated 03.02.2023. The Corporate Debtor was granted 10 days’ time to file the reply affidavit, subject to the payment of Rs. 25,000 as cost to the Counsel for the Petitioner within a week.It is noteworthy that the case will be heard again on 19/04/2023, and we will provide further updates as they become available.
