Article 370 hearing
Former Chief Minister of Jammu and Kashmir and President of the People’s Democratic Party (PDP), Mehbooba Mufti, has made a significant statement, asserting that the “idea of India is on trial” as the Supreme Court addresses the petitions challenging the abrogation of Article 370. This move, which divided the erstwhile state into two Union Territories, Jammu and Kashmir, and Ladakh, was referred to a Constitution Bench in 2019.
Ms. Mufti expressed her contentment with the Supreme Court’s involvement in the matter, stating that it is not merely a legal concern, but also an emotional one for the people of J&K. She commended the lawyers for representing the voiceless people of the region and offering them a platform through these petitions.
During the ongoing arguments in the Supreme Court, Ms. Mufti claimed that the ruling party, BJP, has exploited its parliamentary majority to undermine the Indian Constitution. She highlighted the contentious decision to revoke the special status of Jammu and Kashmir, asserting that it is not just the legal and democratic systems that are on trial, but also the very essence of India’s idea itself.
The case is being heard by a bench comprised of Chief Justice of India DY Chandrachud and Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant. The proceedings have drawn attention not only due to their legal significance but also for their broader implications on the country’s constitutional and democratic values.
As the hearings continue, Mehbooba Mufti’s words underscore the gravity of the situation, emphasizing the need to balance legal decisions with the preservation of India’s diverse socio-political fabric. The Supreme Court’s verdict on the challenges to Article 370’s abrogation will undoubtedly shape the trajectory of Jammu and Kashmir’s status and influence the broader discussions on the idea of India.
