NCLT Showdown: Will Adv Udai Chandani Lead Synergy Ventures to Victory, Recovering 9.5 Cr from Rudra Buildwell’s 2000 Cr Empire?

Delhi, August 25, 2023: As the legal battle between Synergy Ventures and Rudra Buildwell Project Pvt. Ltd. continues, all eyes are now on the upcoming NCLT hearing scheduled for August 30, 2023. The central question remains: Will Adv Udai Chandani, representing Synergy Ventures, successfully navigate the intricate legal landscape and secure a recovery of the 9.5 crore claim from the formidable 2000 crore worth enterprise, Rudra Buildwell?

The dispute, which began with Synergy Ventures filing two petitions—IB-76/PIB/2022 and IB-77/PIB/2022—against Rudra Buildwell Project Pvt. Ltd., has captured the attention of the industry. The debt owed by the latter to the former, amounting to 9.5 crores, has turned into a high-stakes legal affair that now stands before the National Company Law Tribunal (NCLT).

Adv Udai Chandani, along with co-counsels Shivam Kumar and Saurabh Pandey, has been at the forefront of Synergy Ventures’ legal representation. On the other side, Advocate Ravindra Singh continues to champion Rudra Buildwell’s case. The previous hearings saw arguments, submissions, and a crucial recall of an earlier NCLT order, allowing Rudra Buildwell an opportunity to present its reply affidavit.

As the NCLT reconvenes on August 30, 2023, anticipation and uncertainty grip the construction industry. Rudra Buildwell Project Pvt. Ltd., a significant player in the sector, faces potential repercussions if the judgment favors Synergy Ventures. The outcome of this hearing could shape not only the financial standing of Rudra Buildwell but also the legal precedence for similar cases in the future.

The broader construction industry continues to observe the proceedings closely. The case’s implications reach beyond the immediate parties involved, touching upon the intricacies of corporate debts, legal strategies, and the role of NCLT in resolving such disputes.

In a landscape where financial stability and business reputation are intertwined, the fate of Rudra Buildwell Project Pvt. Ltd. hangs in the balance. The impending decision by NCLT will either provide a resolution that both parties can accept or set the stage for further legal battles.

The 30th August hearing is poised to be a pivotal moment in the ongoing saga, offering answers to the questions that have captured the attention of industry experts, legal professionals, and stakeholders alike. As Adv Udai Chandani strives to secure justice for Synergy Ventures, the construction sector braces for a decision that could leave a lasting mark on its future.
In a heartfelt gesture of acknowledgment, Rajat Mohan Pathak, the proprietor of Synergy Ventures, has expressed his profound gratitude to Prime Minister Narendra Modi for the establishment of the National Company Law Tribunal (NCLT). Mr. Pathak’s appreciation is accompanied by his hopeful anticipation that the NCLT will deliver justice in the ongoing dispute. As the NCLT hearing on August 30 approaches, his gratitude reflects his optimism for a fair resolution to the matter, further emphasizing the crucial role of institutions like the NCLT in upholding corporate integrity and accountability.

Crime Branch Kashmir Files Chargesheet Against Man for Submitting Fake DOB Certificate During Job Application

Crime Branch Kashmir has taken a significant step towards ensuring the integrity of the hiring process by producing a chargesheet against an individual who allegedly submitted a fake date of birth (DOB) certificate while applying for a job at Royal Springs Golf Course (RSGC), Srinagar. The accused, identified as Mohammad Sidiq Qazi, is now facing legal consequences for his actions.

According to the statement released by the Crime Branch Kashmir, a complaint was lodged by concerned employees of RSGC, claiming that Mohammad Sidiq Qazi, who currently serves as a barman at the golf course, had provided false information regarding his age at the time of his initial appointment. The investigation was initiated in 2022 under Case FIR No. 57/2022.

After a thorough inquiry, it was revealed that Qazi had indeed submitted a counterfeit DOB certificate during his job application, which allowed him to unlawfully continue his service beyond the appropriate age of superannuation. This deceptive act not only compromised the fairness of the employment process but also raised questions about the transparency and credibility of the hiring system.

Consequently, the Crime Branch Kashmir has presented a chargesheet against Mohammad Sidiq Qazi in the court of Judge Small Causes, Srinagar. The chargesheet cites violations under Sections 420, 468, and 471 of the Ranbir Penal Code, pertaining to fraud and forgery. This legal action underscores the commitment of the authorities to uphold the principles of justice and maintain the integrity of public service recruitment.

The case serves as a reminder that dishonest practices during job applications can have severe ramifications and reinforces the significance of adhering to ethical standards in all aspects of professional life. As the judicial process unfolds, the outcome of this case is expected to send a strong message about the zero-tolerance approach towards such fraudulent activities within the employment sector.

  • Agri And Allied Sector Contribution To GDP Can Further Rise By Strengthening Marketing; FPOs Are Key: Shah

Agri And Allied Sector Contribution To GDP Can Further Rise By Strengthening Marketing; FPOs Are Key: Shah

New Delhi, July 14: Cooperation Minister Amit Shah on Friday said the contribution of agriculture and allied sectors to the country’s GDP can further be enhanced by strengthening marketing, for which farmer producer organisations (FPOs) are the key.
Addressing a conclave here, the Minister said agriculture can become a profitable venture if modern technology and marketing methods are adopted. Primary Agricultural Credit Societies (PACS) and FPOs can help in this endeavour.
He urged both FPOs and PACS to operate in a “hybrid model” under which around 11,770 FPOs that have already been set up can link themselves with PACS through an agreement to provide services to cooperative members. Existing 65,000-odd PACS can begin operating as FPOs. Stressing the need to work in a hybrid model, Shah said: “GDP (Gross Domestic Produce) is very important for any country. If you increase GDP through manufacturing, the job creation will not be much. If you strengthen agriculture and allied sector through cooperatives, not only GDP but job opportunities will also increase.” Although agriculture and allied sectors are contributing about 17.5-18 per cent to the country’s GDP, higher than other sectors, the situation of farmers is not as good as the people engaged in the services sector, he said.
To improve the farmers’ living conditions as good as those engaged in the service sector, “we need to accept FPOs,” he said.
FPO is an organisation of farmer producers that provides support to small farmers with end-to-end services covering almost all aspects of cultivation from inputs, technical services to processing and marketing.
In addition to existing FPOs, the government has set a target to set up 10,000 FPOs by 2027-28 under the aegis of the agriculture ministry. Of which, the cooperative ministry has been given the mandate to set up 750 FPO and recently another 1,100 FPOs.
Asserting that PACS and FPOs are a new beginning, Shah said it is necessary to adopt modern technologies and marketing tools in order to make farming profitable at a time when 85 per cent of the farmers are small and marginal with less than one hectare farm land.
He said a committee had suggested FPOs in 2003 during the Atal Bihari Vajpayee government but it was kept in cold storage. It was Prime Minister Narendra Modi who decided to promote FPOs to further boost the farm and allied sectors.
“FPOs have benefitted a lot to the farmers. But in the cooperatives sector, FPOs and their benefits had reached a limited extent. …Recently, a decision was taken to set up 1,100 FPOs through PACs,” he said and urged PACS to take advantage of FPOs.
If PACS are strengthened as FPOs, it will benefit the cooperative sector, he added.
The minister said there are several types of FPOs — the one run by individuals, partnerships, companies and now PACs. But FPOs formed by PACS are more capable to provide benefits to farmers as compared to FPOs set up by individuals, companies and partnerships.
“PACS, FPOs and Self Help Groups” are the three organisations which will help in achieving agriculture growth and rural development in future, he added.
According to Shah, currently, 11,770 FPOs are working in the country and lakhs of farmers are benefitting from them.
“I want to urge those already set up 11,000-odd FPOs that you continue to operate as FPO but link yourself with one or two PACS and work in an hybrid model… Slowly start linking FPOs with PACS. If you do so, it will bring miracles in PACS,” he said.
FPOs can have an agreement with PACS to provide services to farmers who are members of the cooperative, he added.
PACS and FPOs through an agreement can share information, marketing and profit, he said and asked National Cooperative Development Council and officials of the cooperation ministry to finalise a draft agreement in this regard.
Shah highlighted the initiatives taken by the Modi government in the last 9 years in the agriculture sector to boost farmers’ income.
He said the budget of the agriculture sector in 2023-24 is Rs 1.15 lakh crore as against around Rs 22,000 crore in 2013-14. He said the MSP has been increased significantly and strengthened procurement operations.
Agriculture Minister Narendra Singh Tomar and Minister of State for Cooperation BL Verma also attended the event.
